ATIKU WILL DEFEND HIS CITIZENSHIP IN COURT ON MONDAY 23
Hon. Justice I E Ekwo of court 6 of the Fedral High Court Abuja will hear the suit filed by the Incorporated Trustees of Egalitarin Mission for Africa on monday
The hearing will commence on febraury 23, two days after the rescheduled presidential election, Atiku must be disqualified based on circumstances surrounding his citizenship
The suit was filed on 11th of febraury 2019 at the fedral high court which is asking the interpretations of Section (1) & (2) and 131 (a) of the amended Constitution of the fedral Republic of Nigeria 1999.
The Peoples Democratic Party (PDP), Independent National Electoral Commission (INEC), Attorney General of the Federation and Minister of Justice were named by the group as defendants in the suit and they want the court to explain the following
1 If section 25 of the 1999 constitution is the principal authority that defines ways in which an individual can become a Nigerian citizen by birth?
2 According to the provisions of section 131 (a) of the 1999 constitution, only a Nigerian citizen by birth can contest for the office of the president
That if by the interpretation of sections 25 (1) & (2) and 131 (a) of the 1999 constitution and the situation on the birth of Alhaji Atiku Abubaka, can he be cleared by his party (PDP) and INEC to contest to the prime office of the president of the Federal Republic of Nigeria?
The plaintiff said if the court resolves the issues in its favour, it should declare in accordance to the provisions of the 1999 Constitution, only a Nigerian by birth can contest for president.
From an affidavit deposed in support of their action, they averred that Atiku was born as a Cameroon.on November 25, 1946
And from Atiku’s own testimony gazetted and published in most national dailies in circulation, he is from Jada town in Adamawa and Jada used to be in Ganye Local Government Area in Adamawa.
